EXP Legal has recently assisted, with a successful outcome, an Italian national with international experience in the tourism sector in obtaining an E-2 visa for the United States, together with an E-2 dependent visa for her minor child.
This case is particularly noteworthy not only for its positive outcome, but also for the complexity of the issues addressed and resolved throughout the process.
The engagement involved reviewing and strengthening the documentation prepared for an investment in an operating U.S. company based in Nevada, acquired through a majority ownership interest, as well as providing strategic support in preparation for the consular interview.

Key challenges
The case presented several typical E-2 challenges, further complicated by the specific features of the transaction:
– demonstrating that the investment qualified as “substantial,” despite its relatively limited absolute value;
– addressing partial traceability of funds by reconstructing the financial flows;
– properly framing the applicant’s role as a key figure in directing and developing the business;
– ensuring overall consistency between the documentation and the statements to be made during the interview.
Work performed and timeline
The work was structured in two main phases.
A first phase, between September and October 2025, focused on in-depth technical advisory, including a full review of the application package, identification of critical issues, and strengthening of both the documentary evidence and the business narrative.
As part of this process, it was also necessary to revise certain internal corporate documents, in order to align specific organizational and operational aspects of the company with U.S. immigration requirements. This step highlights how E-2 assistance often goes beyond the preparation of the application file, extending to corporate and contractual adjustments where needed.
In November 2025, the application was formally submitted, and the complete dossier was filed with the U.S. Consulate in early December.
Following standard consular processing times, the interview took place in March 2026 and was successfully passed.
Outcome
The process concluded successfully, with the issuance of the E-2 visa to the investor and the E-2 dependent visa to her minor child.
This case demonstrates that, even in complex scenarios, a structured, multidisciplinary approach—ensuring alignment between corporate, financial and narrative elements—can be decisive in achieving a successful outcome.
