EXP Legal has\u00a0recently assisted, with a successful outcome, an Italian national with international experience in the tourism sector in obtaining an E-2 visa for the United States<\/strong>, together with an E-2 dependent visa for her minor child.<\/p>\n

This case is particularly noteworthy not only for its positive outcome, but also for the complexity of the issues addressed<\/strong> and resolved throughout the process.<\/p>\n

The engagement involved reviewing and strengthening the documentation prepared for an investment in an operating U.S. company based in Nevada<\/strong>, acquired through a majority ownership interest, as well as providing strategic support in preparation for the consular interview.<\/p>\n

The team was led by Avv. Stefano Rossi<\/strong>, with the support of Dott. Simone Di Mario<\/strong>.<\/p>\n

Key challenges<\/strong><\/p>\n

The case presented several typical E-2 challenges<\/strong>, further complicated by the specific features of the transaction:<\/p>\n

– demonstrating that the investment qualified as \u201csubstantial,\u201d despite its relatively limited absolute value;
– addressing partial traceability of funds by reconstructing the financial flows;
– properly framing the applicant\u2019s role as a key figure in directing and developing the business;
– ensuring overall consistency between the documentation and the statements to be made during the interview.<\/p>\n

Work performed and timeline<\/strong><\/p>\n

The work was structured in two main phases<\/strong>.<\/p>\n

A first phase, between September and October 2025<\/strong>, focused on in-depth technical advisory<\/strong>, including a full review of the application package, identification of critical issues, and strengthening of both the documentary evidence and the business narrative.<\/p>\n

As part of this process, it was also necessary to revise certain internal corporate documents<\/strong>, in order to align specific organizational and operational aspects of the company with U.S. immigration requirements. This step highlights how E-2 assistance often goes beyond the preparation of the application file, extending to corporate and contractual adjustments where needed.<\/p>\n

In November 2025,<\/strong> the application<\/strong> was formally submitted, and the complete dossier<\/strong> was filed with the U.S. Consulate in early December.<\/p>\n

Following standard consular processing times, the interview took place in March<\/strong> 2026<\/strong> and was successfully passed.<\/p>\n

Outcome<\/strong><\/p>\n

The process concluded successfully, with the issuance of the E-2 visa to the investor and the E-2 dependent visa to her minor child.<\/p>\n
